The fifth constitutional, a provision in the Federal Constitution of 1988, provides that a fifth of all Brazilian courts have members from the advocacy and the Public Attorneyship.
And what was the biggest consequence of this institute? New ideas, coming from activist and revolutionary minds, began to influence jurisdiction in the courts. Add a whole political component where the clashes, the hidden interests and the militancy started to act in an area where this is not naturally applicable to the point of having a promiscuous relationship between the law, politics and physiology, making the State looming.
Today we have witnessed the appointment of Kassio Nunes, a career lawyer who, through the fifth constitutional, rose to the post of judge of the TRF-1, assuming a prominent position in the court until he assumed the position of judge of the STF. Because of his age, he will be able to stay in the highest court for 27 years.
The center-wing big boys and the progressives have been loving the Fifth Constitutional since its creation, 86 years ago, when during the Vargas Government this infernal institute was created in the Constituion of 1934. Since then, it has been repeated in every subsequent constitution. What a pathetic little man Vargas was!
